Nanaimo, Canada – A disturbing sexual assault case concluded with significant prison time for the perpetrator, as the court heard the harrowing details of an attack on a young woman left with long-term injuries and psychological trauma. Initially meeting the victim outside an apartment complex, where she had been babysitting, the assailant took advantage of a casual encounter that turned violent.
The assailant, identified as Nielsen, initiated what started as a consensual interaction but rapidly escalated into a brutal assault involving choking, hair-pulling, and forced oral and anal penetration – actions to which the young woman repeatedly voiced her refusal. The attack occurred in a secluded shed near the apartment’s dumpsters, adding to the gravity of the assault.
During the trial, the emotional and physical repercussions of the assault on the victim were central to the proceedings. At 21 years of age, she took the stand to detail the ongoing impact of the event, which included severe mental and physical challenges. Diagnosed with Post Traumatic Stress Disorder, she suffers from anxiety that impedes her ability to form and maintain relationships with those close to her.
Apart from the psychological toll, the victim faced acute financial difficulties due to medical expenses and lost income, totaling over $8,500. Despite these considerable hardships, no restitution was ordered by the court for Nielsen to compensate the victim.
The defense portrayed the assault as a consensual encounter, a claim starkly contradicted by the evidence and witness statements, including detailed descriptions of the victim’s injuries which supported the severity of the assault. This claim was further diminished by Nielsen’s criminal history and psychological assessment, which were highlighted during the trial.
Justice Brongers presided over the case, emphasizing the calculated nature of the assault and Nielsen’s attempts to silence his victim. In delivering his decision, Justice Brongers referenced the guidelines from the B.C. Court of Appeal for serious sexual assault cases, asserting that a community-based sentence would be inappropriate given the circumstances.
Prosecutors advocated for a prison sentence of three to three-and-a-half years, while Nielsen’s defense argued for a lesser, non-custodial sentence complemented by probation. Ultimately, the judge rejected the defense’s plea for leniency, underscoring the lack of remorse and the severity of the attack.
Nielsen was ordered to a prison sentence of several years and, upon release, he will be placed on a national sex offender registry for 20 years. Additional penalties included a 10-year ban on possessing any firearms or weapons and a lifetime restriction on owning restricted or prohibited firearms.
